課程概述 Course Description

本課程要對於國際戰爭法(或稱為人道國際法)作一宏觀概述。本課程之第一部分是從戰爭原因法(ius ad bellum)開始。它告訴我們何時一個國家對他國宣戰或使用武力可以被正當化。戰爭原因法對於走向戰爭之行為設下了限制。 本課程的第二部分是討論:規範在戰爭期間甚麼行為可以做以及甚麼行為不能做之國際法規範(戰爭行為法,ius in bello)。戰爭行為法之目的是要限縮對於戰鬥人員與對於平民百姓,以及對於那些不再有能力戰鬥之人所遭受到的痛苦。因此傷患、病患、海難人員、與戰俘均需要戰爭法律的保護。
This course provides an overview of the international laws of war ( known as the international humanitarian law). The first part of this course begins with the ius ad bellum which establishes when a nation may be justified in declaring war or using force against another nation. Ius ad bellum creates limits to the act of going to war. The second part of the course deals with the international rules (jus in bello) which regulate what can be or can not be done during an armed conflict. Its aim is to limit the suffering caused to combatants and to civilians and those no longer able to take part in hostilities. Thus, the wounded, the sick, the shipwrecked, and prisoners of war also require protection by laws of war.

  • 培養學生認識,在聯合國憲章武力禁止底下,集體安全體系與集體防衛體系之運作。
  • 使學生能夠分析各種國際戰爭之起因,以及聯合國安理會之處理方式。
  • 培養學生分析與處理在戰場上軍人如何對待敵方之戰俘、傷患、平民之國際法問題。
