課程概述 Course Description
基於司法回應主權在民,促進法治觀念的植根以及提昇對司法的信任,我國已正式立法通過國民法官法,預定自2023年1月起施行。引進國民參與 刑事審判,是我國司法制度及刑事程序的重要變革,本課程將從比較法制的觀點檢討陪審、參審制及我國不同參與類型之異同及利弊,並檢討刑事 訴訟程序應有的配套措施以及引進國民法官參與審判對於刑事程序法及實體法的影響。In order to respond to the sovereignty of the people in the administration of justice, to promote the rooting of the rule of law and to enhance trust in the judiciary, the National Judges Law has been enacted and is scheduled to take effect from January 2023. Introduction of National Participation This course will review the similarities, differences, advantages and disadvantages of the jury and trial system and the different types of participation in our country from the perspective of comparative legal system. This course will review the advantages and disadvantages of the jury and trial system and the different types of participation in China from a comparative legal perspective.
