課程概述 Course Description

海事法基本上可大略區分為公法與私法兩大領域。海事公法包括國際海洋法(屬國際公法)與海事行政法(如船舶法、航業法)等;海事私法則包括海商法等。海商法有廣義與狹義之分,廣義指一切與海商事件相關之一切國內外法規範;狹義則指我國立法院所通過之海商法。既稱海商,其須屬在海上及與海相通水面(中),以船舶經營商業活動方可,包括運送(貨物運送、旅客運送暨船舶拖帶)、海難救助與海上保險等。因此,除導論外,將區分海商企業之組織、海商企業之活動、海商企業之危險及海上保險來做介紹。
The Law of carriage of goods by see is to let students understand the basic rules and principles of maritime law, including the definition of ship, the liability of ship owner, the liability of carrier. In order to achieve that purpose, an introduction to C.I.F. & F.O.B. contracts, carriage of goods contracts, multimodal contracts, bills of ladings are necessary. Finally, maritime insurance is also studied.
