課程概述 Course Description
部門憲法的建構,並非是為了取代傳統法釋義學,相反地,透過對於臺灣憲法文本的重視,來彌補憲法釋義學不夠本土化的缺失。 具體來說,憲法規範的解釋過程是應然面與實然面的詮釋循環,因此能夠以「部門」來承擔規範體系內部,以及規範與現實之間的整合功能。「部門憲法論述」強調「從憲法所規範的領域回過頭來決定憲法的解釋」,屬於一種特殊的「體系解釋」,不但在基本權、中央政府體制、中央地方權限、基本國策等規定之間作橫切面的體系化,更可經由規範領域與規範之間的詮釋循環,建立足以反映該規範領域特性的規範體系。 「部門人權、部門憲法與部門行政法」:企圖從憲法的基本權目錄規定尋找部門人權,並從該部門的基本權功能連結到該部門憲法的體系建構,最後依此部門憲法的體系型塑部門行政法的基本架構。The construction of the departmental constitution does not intend to replace the traditional doctrinal studies of law. On the contrary, it makes up for the lack of localization of the doctrinal studies of constitutional by attaching importance to the text of Taiwan's constitution. Specifically, the interpretation process of constitutional norms is a cycle of interpretation between to be and ought to be. Therefore, the “department” can be used to undertake the integration function within the normative system and between norms and reality. " Departmental Constitution " emphasizes "deciding on the interpretation of the constitution from the field regulated by the constitution", which is a special means of "system interpretation", not only can it systemize between basic rights, central government system, central and local authority, basic national policy, etc. The systematization of the cross-section can also be used to establish a normative system that reflects the characteristics of the normative domain through the interpretation cycle between the normative domain and the norm. "Departmental Human Rights, Departmental Constitution, and Departmental Administrative Law" attempt to find departmental human rights from the basic rights catalogue of the constitution, and link the department’s basic rights function to the construction of the department’s constitution; finally shape the basic structure of departmental administrative law according to the system of the department’s constitution.
