課程概述 Course Description
人是國家的目的，國家是為了人而存在，並非是人為了國家而存在。這樣的想法，基本上是近代立憲主義過程中所要追求與保障的實質內涵。因此，大多數的立憲主義國家，都會把人民的基本權寫在憲法的最前頭，以明白揭示這個憲法的靈魂。然後，再經由國家組織的設計，去維護與實踐這樣的憲法精神。而存在於人民的基本權與國家的組織設計中的連結橋樑，就是法秩序。就此而言，憲法釋義學的體系建構，是嘗試思考：在合於憲法之自由民主法治的基本價值下，如何透過整體法秩序的規範作用，去設計與規劃國家的組織體系，而實踐人民基本權的保障，促成人的自我實現的最大可能性。這也是本課程的開設理念。 本次憲法基本問題研究課程，將主題對焦在：憲法在台灣的實踐 — 從司法院大法官解釋的檢討，希望透過基本權在台灣實踐的檢討，讓大家瞭解出未來憲法學者在台灣努力的方向。The purpose of the state is man, and the existence of the state is for man, not for the state itself. The idea is basically the essence of the pursuit and guarantee in the process of modern constitutionalism. Therefore, in order to reveal the spirit of the constitution, most constitutional countries will put the basic rights of people in the first place of the constitution. Then, through the construction of the state organization, the state maintains and practice the constitutional spirit. The bridge between the basic rights of people and the organizational construction of the country is the legal order. In this regard, the construction system of the doctrinal study of constitution is trying to think: under the basic value of the constitutional freedom, democracy and the rule of law, how to design and plan the organizational system of the state through the normative role of the law order, practice the basics rights of people, and promote the maximum possibility of self-realization. This is also the concept of this course. This course would focus on the theme: the practice of the constitution in Taiwan--from the review of the interpretation of the judges of the Judicial Yuan. Hope that through the review of the practice of fundamental rights in Taiwan, everyone can understand the direction of future constitutional scholars in Taiwan .
