課程概述 Course Description

魚類提供人類獲取蛋白質等各種重要養分,而魚類的來源,不外乎養殖與海洋或河湖漁撈。魚類養殖,不管是陸上魚池養殖、河域養殖或近海養殖,均存在各種不同的法律問題。例如:養殖水源的取得與排放,即與水利法及地下水保護的法律問題,甚至是水污染防治的問題有關。養殖魚類、進出口魚類及捕撈魚類衛生,與食品安全衛生及貨源證明等法律問題有關;養殖量與產銷價格控制的法律問題,亦有關聯。 其次,關於捕撈,不管是河湖、近海或遠洋捕魚、專業漁撈或娛樂性漁撈,涉及漁業權的取得﹙與國際協定有關﹚與捕魚糾紛的預防﹙特別是與鄰近國家及中國大陸﹚與處理、漁船與人員的安全、魚源永續發展與生態保護等法律問題,亦值得注意。
Brief Introduction: With the gradual reduction of marine fish resources and the increase in demand, the fishing and conservation of marine fish, how to maintain a balanced ecology, prohibiting overfishing, and even fishing resting and fishing prohibition have become important legal issues. Due to the high risk of fishing at sea, high cost, unclear ownership of fish farms, and the fact that countries have stepped up their enforcement in their exclusive economic zones, cross-border fishing, mixed fishing or overfishing has become an important cause of international disputes. Although fish farming is an important method to solve the predicament of marine fish fishing, there are still problems such as soil and water conservation, sanitation, loss of natural disasters and fishery, and compensation. It depends on the legal system to solve those problems. This seminar is designed to solve these problems.
