課程概述 Course Description

營建工程法律作為法學專業法律領域之一,除工程技術知識外,其涉及許多民事法律、特別行政法規及工程慣例等問題。工程/營建工程/建築工程契約之內容及法律關係十分繁雜,且因履約期限較長,履約過程中之風險與變數亦較多,爭議亦隨之增多。此外,工程/營建工程/建築工程契約爭議問題,不僅涉及到專業之法律問題,亦常與工程之專業問題有關,更增契約爭議處理之困難。 本課程將以(公共)工程契約之成立(含招、投標)、履約、保固過程中常見爭議為討論核心,輔以民事法之學說理論研究,闡述分析(公共)工程契約爭議相關之重要課題及探究研酌工程糾紛解決之處理途徑,期能促進(公共)工程契約完善議約擬約、進行積極之履約管理並發揮工程糾紛預防之效。
As one of the legal fields of law, construction engineering law involves many issues such as civil law, special administrative regulations and engineering practices in addition to engineering technical knowledge. The content and legal relationship of construction contracts are very complicated, and due to the long performance period, there are more risks and variables in their performance process, and related legal issues and disputes also increase. In addition, construction contract disputes not only involve professional legal issues, but also often related to construction engineering professional issues, which adds to the difficulty of handling contract disputes. This course will focus on common disputes during the establishment, performance, and warranty of construction contracts, supplemented by theoretical research of civil law, expounding and analyzing important issues related to construction contract disputes and exploring ways to resolve construction disputes.
