課程概述 Course Description

一、研究現代憲法之基本理論 二、研究現代憲法之人權理論  三、研究中華民國憲法之人權條款 四、研究人權事例或人權爭議事例 伍、研究司法院大法官會議對於保障人權之憲法解釋 
The purpose of this course is to study constitutional democracy theory, the constitution of Republic of China(Taiwan), and government organizations of Taiwan. The course outline: 1. the theory of constitutionalism, 2. protection of various kinds of human rights, 3. promote public interests and proper restrictions of human rights, 4. the theory of constitutional Charter sovereignty, 5. constitutional laws and natural laws, 6. rule of man and rule of law, 7. social contract and constitutional civilization, 8. social contract and private agreement, 9. equality right and open social stratum, 10. Plural competition and market function, 11. competition of political party and political neutrality, 12. government system of The Republic of China (Taiwan), 13. constitutional explanation of Justice Conference, 14. rules of organization of executive organ and relevant regulations, 15. rules of organization of legislative organ and relevant regulations, 16. rules of organization of judicial organ and relevant regulations, 17. local government system.

    3人權的正當限制,公益原則,法律保留原則,比例原則,違憲審查
    4社會習俗法與人權保障。思想制約與心靈解放。
    5人民主權?公民投票,多數人利益?公共利益,憲章主權,憲政正義
    6分權制衡,政府分權制衡,政府統治權與人民監督權,廣義的分權制衡。
    7政治力與社會力的分權制衡,多元政體,多元社會。
    8統治理性與監督理性,專業理性與基本理性,養成理性與天賦理性。
    9自然定律與憲政定律。發現了憲政定律。科技文明與憲政文明。
    10人生而平等,人民,統治者,社會契約。社會契約主權與憲章主權。
    11社會契約授權法與私人契約授權法。公法地位與私法地位,混和地位
    12封閉的社會階層與開放的社會階層。自由競爭,反壟斷,基本生活保障與人類文明。
    13自由公正的選舉,統治者,監督者,執政黨,監督黨。責任政治,權責一體。
