課程概述 Course Description

在邁入資訊社會後,傳統法律面臨資通科技之挑戰,應該如何適用或修正,誠為法律人必須認識之重要課題。惟一般傳統法律人之學習過程,往往欠缺對科技之認識,而科技人也往往不瞭解技術運用可能衍生之法律問題,致使現今資訊社會的法制仍未健全。本課程作為一跨領域整合之嘗試,期待法律人參與後,能對新興法律爭議中相關技術具有基礎知識,也期許非法律人學習後能正確瞭解相關法律之適用。 由於資訊社會中新興的法律議題十分廣泛,第一學期除先勾勒資訊法律環境(架構)外,將主要探討網路智財法(IPR)、資訊安全與電子商務相關重要議題,其餘如電子簽章、紛爭訴訟外處理機制等重要議題,或已探討主題之更新補充,將留待下學期繼續研習。 授課方式除教師講授外,將適度邀請外部學者、專家參與分享專業知識,以豐富上課內容。
Information Society and Law (1) After entering the information society, traditional laws are facing challenges from information technology. How to apply or amend them is an important topic that legal professionals must understand. However, in the learning process of ordinary traditional legal persons, they often lack the knowledge of technology, and technologists often do not understand the legal problems that may arise from the use of technology, so that the legal system of the current information society is still not perfect. This course is an attempt to integrate across fields. It is expected that after legal persons participate, they can have basic knowledge of relevant technologies in emerging legal disputes, and that non-legal persons can correctly understand the application of relevant laws after studying. Due to the wide range of emerging legal issues in the information society, in addition to the outline of the information legal environment (structure), the first semester will mainly discuss important issues related to Internet Intellectual Property Law (IPR), information security and e-commerce, and the rest such as electronic signatures. Important topics such as chapters, mechanisms for handling disputes outside of litigation, or updated and supplemented topics that have been discussed, will be reserved for continued study in the next semester. In addition to teaching by teachers, external scholars and experts will be appropriately invited to participate in the sharing of professional knowledge in order to enrich the content of the class.
