課程概述 Course Description
希望能使同學對國際金融法充分之了解，為配合大陸法系所習慣之體系化思考方式，特將原本雜亂無章的國際金融法，架構體系而成國際金融法總論與各論，並將與貿易相關者獨立成為國際貿易融資法。總論部分探討國際金融法具有一般適用性的問題，例如銀行間關係（包括銀行間聯合關係），各論則介紹現在國際金融實務上重要的契約及金融商品。 至於國際金融法的公法部分，包括國際金融組織法等，則在相關章節概述之。Topic research on the law of international finance is to introduce the definition of banks, universal banking model, the structure of international banks, bank’s duty of care and confidential duty, clearing, netting and settlement, contractual set-off, securitization. The relations among banks and other financial institutions are also studied.
