課程概述 Course Description
勞動法之定位、勞動法之體系、勞動法之法源。勞動法領域傳統上分為個人勞動法與集體勞動法,前者包含勞動契約法、勞動保護法、勞動訴訟法,後者包含勞動三法與及工業民主法制。其中無論是就傳統法律概念的再深入檢討(如工資、工時的定義,休假之定位,退休照顧之定位等),或是勞動法與其他保護領域之交互作用(如勞工保險、兩性工作平等法、公務人員照顧),或是勞動政策面的許多考察(工會體制的檢討、團體協商的走向、外籍勞工政策)等等,都有許多討論的方向有待挖掘。Introducing the system of labor law. Containing the legal sources, basic structure and current legal issues of labor law. The field of labor law is traditionally divided into individual labor law and collective labor law. The former includes labor contract law, labor protection law, and labor litigation law, and the latter includes laws of unions, group agreements and labor dispute.
