課程概述 Course Description

國際爭端之和平解決於國際法上扮演重要角色。國際法上之爭端解決具有一個特徵:介於以和平方式解決爭端之法義務與欠缺任何真正之強制機制來有效貫徹義務之間之固有的緊張關係。為了對抗此種法律背景,爭端解決之概念涵蓋眾多不同之解決方式。本課程要介紹許多不同的國際爭端解決之方法,其包括:談判、斡旋、調解、和解、仲裁、與司法解決本課程將討論國際法上國際爭端和平解決之基本構想與相關問題。本課程之焦點原則上集中在各種不同之國際組織中之司法解決(比如:國際法院(聯合國)、歐洲法院(歐盟)、爭端解決機構(世界貿易組織)),以及集中在各種不同領域之國際公約上的司法性解決(例如在國際人權領域:人權事務委員會(公民權與政治權利公約)、歐洲人權法院(歐洲人權公約);在國際海洋法領域:國際海洋法院(聯合國海洋法公約);在國際刑法領域國際刑事法院(國際刑事法院章程)。
Peaceful settlement of international disputes plays a central role in international law. The dispute settlement at the international level is characterized by an inherent tension between a legal duty to settle disputes in a peaceful way and the absence of any real compulsory mechanism that may render such obligation effective. Against this legal background, the notion of dispute settlement covers a great variety of different settlement devices. This course provides introduction to different means of international dispute settlement. They include negotiation, good offices, mediation, conciliation, arbitration and judicial settlement. In this course we will discuss basic concepts and issues concerning peaceful settlement of international disputes in international law. The principal focus will be on the judicial settlement in different international organizations (such like: ICJ(UN), ECJ(EU), Dispute Settlement Body (WTO)), and in different areas of conventions (in area of international Human Rights : HRC(ICCPR), ECtHR(ECHR); in area of international law of the sea: ITLOS(UNCLOS); in area of the international criminal Law: ICC(ICCS).
