課程概述 Course Description
憲法與政治學二者皆考慮國家之整體,但二者各自以不同之觀點以及以不同之方向來考慮。為了更徹底地了解國家,國家學這門課使用這兩種學門的切入點。法律系學生若沒有政治學的知識,則無法正確地解答在現實世界中所發生的實際問題。因為憲法並非只是法律條文。憲法是整體社會的條件。憲法概念觸及整體社會,這個事實使得憲法越來越像另一個概念:國家。國家與憲法發展成為整體的,但可互換的範疇。這一點正當化了將憲法切入點與政治學之切入點加以連結起來。 國家學基本上在討論領土國家中之統治以及對於在國家上的人民行使權力之正當結構之問題。為了理解法學上的爭議,所以我們需要清楚地區分主權之規範性與正當性。本課程以綜合觀察主權構想在歷史上的發展為開始。本課程將下面的問題納入考慮:十六世紀發生何種問題而可以用主權之構想來解決?主權理論是否正當化了國王之無限制的權力?為何主權國家應被改變,以及被憲政國家取代?立憲主義的構想真正的意義為何?民主理念如何正當化主權之行使?Constitutional law and Politics both consider the state on the whole, but each from a different point of view and in a different direction. In order to understand the state more thoroughly we apply both approaches of them in the course “The Theories of the state”. Without the knowledge of Politics the law students are not able to find the correct solution to a practical problem occurred in the real world. For the constitution is not merely the legal text. It is the total condition of society. The fact that the concept of constitution reaches out to the entire society makes it more and more similar to another concept - the state. State and constitution developed into integral, but interchangeable categories. This justify the combination of the approaches of constitutional law and Politics. Theories of the state deal essentially with questions on the legitimate structure of domination in territorial states and the exclusive exercise of power over the people who live therein. In order to understand debates in jurisprudence one needs to distinguish clearly between normativity and legitimacy of the sovereignty power. The course begin with the overviews of the development of the concept sovereignty in history. It will take the following questions into account: What kind of problem that occurred in 16. Century could be solved with the idea of sovereignty? Did the theory of the sovereignty justify the unlimited power of the king? Why the sovereign state should be changed and replaced by the constitutional state? What does the concept of the constitutionalism really mean? How could the idea of democracy justify the exercise of the sovereign power?
