課程概述 Course Description

透過介紹及分析營建工程相關法律,例如:民法、政府採購法、政府採購契約範本、營造業法、工程技術顧問公司管理條例、建築法、建築師法、技師法、促進民間參與公共建設法、國土計畫法及都市更新條例,結合實例研討與情境分析,落實理論與實務合一,以學習工程法律專業知識與解析工程法律實務問題,並培養不同專業的跨領域對話及知識轉換之能力,俾以應用所學之工程法律與管理知識,解決營建工程契約爭議以及預防工程糾紛,提升工程法律實務工作之能力。
This course focuses on introducing and analyzing the relevant laws of construction projects, such as: Civil Code, Government Procurement Act, Government Procurement Model Contracts, Construction Industry Act, Act Governing the Administration of Professional Engineering Consulting Firms, Building Act, Architect Act, Professional Engineers Act, Act for Promotion of Private Participation in Infrastructure Projects, Spatial Planning Act and Urban Renewal Act. To implement theory and practice, this course will use approaches of case studies and scenario analysis, for the purpose of conducting students to learn the legal expertise in Construction Law and to analyze main issues in legal practice as well as cultivating their abilities to face cross-disciplinary dialogue and their capabilities to transfer knowledge of different professions. Consequently, students will be able to apply knowledge of Construction Law and Construction Management which they learned in this course, as well as be capable to solve the construction contract disputes and prevent or avoid conflicts. So they can at mine time improve their competences to work well in the construction and legal practice.
