課程概述 Course Description

本項課程將結合學說與實務，就總論而言，整理分析現行非常救濟程序，包括再審及非常上訴的要件及運作狀況，進而針對各論部分，選擇實務上具有爭議的救援案件，進行案件審查，由實務家協助教學，教導修課同學如何從刑事確定判決所依據的卷證資料、證物等找出可能的疑點，進而判斷案件是否可能沈冤待雪尋求非常救濟的管道。本課程希望藉由分析檢討判決卷宗的教學方式，建立起一套系統性的研究方式，期待不僅能提供修課同學個案實習的機會，進而對我國的冤案救援做出貢獻。
