課程概述 Course Description

本課程之規劃設計,主要係為使學生能藉由本課程之研習,熟悉並掌握票據法之架構與內容,並暸解各個不同票據類型之法律規範。同時,期待學生透過對於票據行為之意義、種類與性質、票據行為之代理、空白授權票據、票據之偽造、變造與塗銷、票據抗辯與時效、票據之喪失、承兌與參加承兌、付款與參加付款、票據保證、票據背書、追索權、匯票、本票與支票等規範之論述與討論,兼佐以實務案例之研析與探討,從而對我國票據法,有一完整之認識,並能將抽象之法律規定,適用於具體實務之中。

課程學習目標 Course Objectives

  1. 學生能描述票據於現代商業社會之功用與重要性。
  2. 學生能夠分辨解釋各種不同票據的類型,同時掌握其不同。
  3. 學生能夠描述各種不同票據行為,並熟悉票據行為人其所涉及之責任。
  4. 學生能分析不同票據行為所產生之法律問題,並能清楚表達
  5. 學生能夠辨識不同票據之可能法律議題,並運用票據法法律規範於實際案例之中。
  6. 學生能以書面或口頭方式將所獲結果與同儕及教師溝通呈現
  1. Students would be able to identify and to explain the various types of instruments in the payment system.
  2. Students would be able to utilize legal principles that apply to different types of instruments.
  3. Students would be able to describe different types of signatories in different instruments and the underpinning legal rationales, and distinguish their legal consequences.
  4. Students would be able to comprehend the difference and issues associated in different instruments and apply relevant law and regulation to any given cases.
  5. Students would be able to communicate results in written or oral form to classmates, teaching assistants, and the instructor.
  6. Students would be able to illustrate the functions and significance of the payment system in our modern business environment.
