課程概述 Course Description
首先於同學就債之性質、種類與請求權競合理論有認識後，將使同學了解債之發生及標的，並使同學了解債之效力。教學順序上則打破法條章節順序，上學期先以債之履行與不履行為中心，橫切檢視民法債編之相關制度（危險負擔、損害賠償、替補賠償與遲延損害、代償請求權與讓與請求權、解除、終止、同時履行抗辯），並就具第三人關連性之型態（利益第三人契約、附保護第三人作用之契約）一併加以介紹。下學期先就使同學對於多數債權人及債務人，特別是連帶債務之規範加以認識後，再進入定金、違約金及撤銷權、代位權等壓力或保全手段。最後再就屬法定之債之不當得利、侵權行為、無因管理來加以介紹。前述部分內容並搭配德國近年債法修正之內容，以期培養同學政策思辨的能力。希望能藉由課程之安排，使同學能於實務面對債法案件時，能正確適用相關的規範來加以評價。課程學習目標 Course Objectives
