課程概述 Course Description
人是國家的目的，國家是為了人而存在，並非是人為了國家而存在。這樣的想法，基本上是近代立憲主義過程中所要追求與保障的實質內涵。因此，大多數的立憲主義國家，都會把人民的基本權利寫在憲法的最前頭，以明白揭示這個憲法的靈魂。然後，再經由國家組織的設計，去維護與實踐這樣的憲法精神。而存在於人民的基本權利與國家的組織設計中的連結橋樑，就是法秩序。就此而言，憲法釋義學的體系建構，是嘗試思考：在合於憲法之自由民主法治的基本價值下，如何透過整體法秩序的規範作用，去設計與規劃國家的組織體系，而實踐人民基本權利的保障，促成人的自我實現的最大可能性。這也是本課程的開設理念。課程學習目標 Course Objectives
培養法律系學生分析憲法問題，與處理憲法問題之步驟，與思考程序，尤其是關於基本權受侵害時，人民如何提起釋憲案。關於違憲審查方面，引導學生如何具體地以憲法論證來處理法律違憲之問題。
