課程概述 Course Description

帶領同學閱讀美國法學名著 使同學學習英美法學著作之閱讀方法 Chapter1:Introduction Chapter2:The rationale for project finance Chapter3:Analysis of project viability Chapter4:Security arrangement Chapter5:Legal structure Chapter6:Prepairing the financial plan Chapter7:Discounting cash flow analysis Chapter8:Financial modeling and project evalution Chapter9:Sources of funds Chapter10:Issues for the host government Chapter11:Case study

課程學習目標 Course Objectives

本課程為大學部同學的外文畢業學分之必選範圍。考量到大學部同學的語文能力、學習動機、與對美國法的基礎認識等各項因素,因此本課程的設計將不以美國法的各項部門法律單元為主,而是以提高同學的英文閱讀興趣、給予同學知識上的刺激與啟發、並提高同學學習外國法律制度與使用美國法學文獻的信心為課程設計目標。
本學期的閱讀文獻主題為「Lawyers, Language, and the Culture of Law: From the Socio-Legal Study Perspective」,所學的三本書籍分別是:「The Happy Lawyer: Making a Good Life in the Law」,「Just Words: Law, Language, and Power」,「The Common Place of Law: Stories from Everyday Life 」。老師將選擇這三本書中的部分章節,分散在每一週課程中,由同學自行分組後,進行翻譯與討論。
選擇這三本書的用意希望可以與大家一起討論:美國律師在法學院都學些什麼?常作為台灣法學教育、甚至是一般普羅大眾仿效或嚮往對象的美國律師,他們的工作與學習實況如何?從事法律實務工作的內涵與成就感是什麼?「法律」以專業術語、特殊機制、與證照門檻所構築起來的這個專業領域,以美國法學院、律師事務所、與美國地方法院為例,有怎樣的法律文化?「法律」如何影響我們的日常生活?進入了「紛爭解決」的領域後,法律如何構築我們對「紛爭」、與我們對日常生活的想像?
此外,本學期將安排兩次影片觀看與討論(紀錄片:卯上麥當勞,紀錄片:監守自盜Inside Job)。以上課程規劃,都是希望同學能夠在這些材料當中,更加體會、反思「法律是什麼?『法律』系都在學些什麼?可以學到些什麼?」。希望選修同學本學期都能夠在這堂課得到啟發與收穫。
